Buy American Act (BAA)

The Buy American Act (BAA), enacted in 1933, is a longstanding federal procurement law that requires the U.S. government to prefer U.S.-made products when purchasing goods for public use. Under the BAA, a product is considered "American-made" if it is manufactured in the United States and a significant portion of its components—typically at least 65% of the cost—are sourced domestically. The BAA applies primarily to direct federal purchases and does not extend to grants or infrastructure projects funded by the federal government (unlike BABA or BA). The law is enforced by federal agencies through contract requirements and is intended to promote domestic manufacturing and support American jobs. Exceptions can be made through waivers, but these are evaluated carefully based on factors like public interest or non-availability of domestic alternatives.
